This Privacy Policy describes the personal data collection practices for theMarketer.biz website and theMarketer services, as defined in the Terms and Conditions. It is owned and operated by S.C The Marketer International Srl and processes personal data as a controller in accordance with this information document.
This privacy policy relates solely to data collected by us as Operators. For the processing of personal data processed for theMarketer Beneficiaries as Processors, to S.C The Marketer International Srl, as empowered person, see https://www.themarketer.com/data-processing-addendum.
This document is intended to inform you about what type of personal data we collect from you, how and where we may use these data, how we intend to protect these data, who has access to it and how inadequacies in the personal data processed can be corrected in time, in accordance with EU Regulation 2016/679 (GDPR).
theMarketer offers software-as-a-service (SaaS) for automated marketing exclusively for legal entities.
In this regard, applying the principle of minimization of data collected under GDPR, theMarketer does not intentionally collect personal data from the natural entities/consumers as a controller, but may collect personal information from representatives of legal entities - customers or potential customers, given their professional contact details.
Also, all theMarketer web site visitor activity is directed towards legal entities and their representatives, but we cannot know for sure the professional quality of our web site visitors or of a person who subscribes to news published on the site.
Thus, we consider all this information as personal data and treat it as such, as detailed below, although it may be personal data only in certain cases:
1. About us
theMarketer or "theMarketer.com" refers hereinafter to S.C The Marketer International Srl, Strada Badea Cartan 66, Sector 2, Bucharest, Office 3, Zone II, Room 2, Bl. 40, Sc. A, Et. 5, Ap. 26, Trade Register Code: J40/7641/21.04.2022, Fiscal code: RO46003544 email: iam@themarketer.com, phone number: +40-724-470-432, is a personal data controller for the purposes of EU Regulation 2016/679 (GDPR), referred to throughout this document as theMarketer.
theMarketer complies with the Romanian and European legislation in force in the field of personal data protection and collects personal data only for specific purposes, as detailed below:
The purpose of collecting personal data is the sale and provision of services on theMarketer (with all related activities such as order processing, payment, billing, service provision, etc.), customer relationship services and marketing activities for theMarketer own needs.
Your personal data is used exclusively by theMarketer for the above purposes and may not be sold or rented to third parties.
The legal grounds for processing these data are:
- legitimate interest in the offer and agreement with the legal entity (Art. 6 (1) f GDPR) - for data collected through the order form or data received as a result of customer services
- legal obligations (Art. 6 (1) c GDPR) for data required for billing and other legal obligations
- legitimate interest (Art. 6 (1) f GDPR for site security and data used for own site optimization.
- Consent (Art. 6 (1) of GDPR) for data used for marketing (e.g. newsletter subscription, marketing cookies, event participation etc.)
2. What personal data we collect and who has access to your data
theMarketer collects information from its users in three ways:
- directly from users
- traffic data
- via cookies.
2.1. Personal data collected directly
When you access theMarketer or when you create an account or place an order, we may ask you for your last name, first name, and/or email address, phone number, as well as other details of the company for which you are registering. Please keep in mind that the account is made in your capacity as a representative of a legal entity and therefore we recommend that you use your company email and phone, not your personal one.
These data are kept for a period of 3 years after the end of the agreement (this is the general limitation period) or 10 years in the case of invoices, starting from the end of the financial year in which they were drawn up. (where it is a legal tax obligation).
We may also ask for an email address or phone number when you access customer support, as well as other details if they are necessary to resolve the problem you have raised. We reserve the right to record any communication made for assistance in order to improve our services. We will inform you before the communication starts that it may be recorded. These data may be kept for different periods, but no longer than 3 years from the last communication or from the termination of the agreement with you, as the case may be.
These data are used, for example, for the purpose of contacting you, establishing the necessary agreement or billing details, or contact person and/or to deal with a complaint/request from you. We may also request other data that may constitute personal data only to the extent that they are necessary for these purposes.
If you do not provide this information, we will be unable to honor your order or provide the support services you require.
Also, when you subscribe to our newsletter or fill out a form on our website or when attending an event organized by us, please provide us with both an email address, as well as a name, and sometimes other information necessary to personalize communication to you.
These data are kept until consent is revoked.
2.2. Information provided automatically from traffic data
When you visit a website, regardless of the device you use, you reveal certain information about yourself, such as your address. IP address, time of your visit, where you entered our sites and visited pages. theMarketer records this information for a specified period of time. theMarketer uses external traffic analysis services such as Google Analytics.
These data are used exclusively by theMarketer to improve our website and services and to ensure the security of our website.
Under no circumstances does theMarketer use traffic data to identify people behind IP addresses.
2.3. Cookies and similar technologies
It should be noted that cookies and similar technologies do not collect direct personal data (name or email), but may in some cases use unique identifiers to track a user from one site to another.
theMarketer may use its own cookies necessary for the operation of the site, but also to facilitate the storage and tracking of your preferences, including for optimization of our sites, including personalization, or for marketing purposes.
With respect to external theMarketer services that place (third-party) cookies or similar technologies when you browse theMarketer sites, their purpose is for marketing, traffic analysis or other personalization purposes, as detailed below:

Most browsers are set to accept cookies automatically. These data are kept for different periods, as determined by these providers, but these do not exceed 60 months from the last visit.
3. How we protect data collected from you
theMarketer is committed to protect your personal data against loss, misuse, disclosure, alteration, unavailability, unauthorized access and destruction, and takes all reasonable precautions to protect the confidentiality of such data, including the use of appropriate organizational and technical measures.
Your access to theMarketer services and products is protected by your account password and a two-factor authentication (2FA) system. We recommend that you do not disclose this password to anyone and that you activate your 2FA system. theMarketer will never ask for your account password in unsolicited messages or phone calls. Only if you call our support services can we ask you to create an administrator account in the application, which we will use for a very limited time - only until the problem is solved - if we cannot solve the problem remotely. Furthermore, if possible, you should remember to click the "Logout" button in your account within theMarketer online services at the end of each session of use. We also advise you to close the browser window in which you were working at the end of your browsing of theMarketer websites or services. These tips are designed to prevent unauthorized people from accessing personal information about you when others may have access to your device.
4. Your rights
Under the GDPR, you have the right of access, rectification or erasure, the right to intervene on personal data or restrict processing or the right to object to processing, as well as the right to data portability, if applicable.
For data collected by consent, you have the right to withdraw consent at any time.
We do not use automated decision-making processes, including profiling, that have legal effects or significant effects on users.
To exercise these rights, you can send an email request to iam@themarketer.com with the specific right you wish to exercise and your identification details. We may ask you for additional identifying information, just to make sure that we do not give your personal data to another user without access rights to it.
You also have the right to lodge a complaint with a supervisory authority or take legal action.
5. Who has access to your personal data
heMarketer may use other IT companies to process personal data collected. These companies are considered as data processors and have strict contractual obligations to maintain the confidentiality of the data processed and to provide at least the same level of security as theMarketer.
All these are in Romania and in the European Union or in any other country/countries offering an adequate level of protection of personal data according to European Union standards (Art. 45 of GDPR) or other appropriate safeguards, including standard data protection clauses (Art. 46 (2) of GDPR).
Due to confidentiality obligations and security requirements, specific information on the name and details of each Empowered Person used may be provided in accordance with applicable law.
These data are sent for the above mentioned purposes such as:
- Hosting services
- Email sending services
- Marketing services
- Technical tools services support or contact customers or future customers (chat, phone calls, email, etc.)
In special circumstances, theMarketer may disclose personal data when expressly provided by law, when requested by a competent authority or when necessary to protect the rights and interests of theMarketer (e.g. to accountants, auditors, lawyers and other external consultants whose work involves a need to know such data).
6. Our clients' data
theMarketer also processes the data collected from our customers through theMarketer services as an empowered person. And for those data we ensure the security of the data collected, as well as all other obligations imposed by GDPR with the same standards we have accustomed you to.
As such, it is necessary to have an agreement between us and our customers based on Article 28 of GDPR and which you can find at https://www.themarketer.com/data-processing-addendum.
7. Other provisions
The Privacy Policy shall be construed in conjunction with theMarketer Terms and Conditions of Use and are subject to the applicable laws of Romania.
This policy has been updated this day, 29.11.2022 and in the future, whenever we change it, we will publish the new version on the front page of theMarketer website.
